Registration of cars in Belgium

Posted in Advice on Nov 14, 2017

The following questions have been addressed to me recently. We give a short answer, not necessary a complete one for practical reasons

Has someone with legal residence in Belgium the right to drive permanently a car which is registered abroad whether in her or his country of origin or in a country where they charge a lower circulation tax?

No, except for a short period (generally not more that 6 months and in specific circumstances…), that is occasional and exceptional circulation for vacation, conference, etc. For more information, call the DIV (Tel 02-2864545; Fax 02-2874327).

What can you do when squatters put their car on your private parking space?

Rules protecting the privacy of the domicile are also applicable to the private parking space. The basic constitutional rule is that no one is allowed into your domicile without your authorisation or a Court order. The domicile includes your garden and your private parking space. Someone parking his car on your private car space therefore violates the privacy of your domicile. You are entitled to have the car ordered by the police to be removed on the costs of the owner

Until when are you entitled to allowances for minor children?

You receive them until the 31st of August of the year when the minor child becomes 18 years (for employees of the private sector and self- employed persons) and until he becomes 21 years for the employees of the public sector. For workers from the private sector and self- employed persons, after the child has reached 18 years, children allowances are given only under certain conditions (for examples when the child in registered as a student or is handicapped). Adopting children leads in this regard to the same rights as for other children. Children allowances are paid as well to Belgian citizens as to expatriates legally living in Belgium since at least five years.
